During this module, you learned about the incident rate of wrongful convictions. And in past modules, you learned about the role of the judge and the appellate process. For your writing assignment this module, you are going to put all of this information together and assume the role of a state appellate judge writing the majority opinion which decides Spoofy’s appeal. Specifically, Spoofy is arguing that he was wrongly convicted, and he is arguing specifically on appeal that his conviction should be overturned because the trial judge erred as a matter of law in denying his motion to suppress. In other words, he is arguing that the trial court should have granted his motion to suppress, and that because the evidence that was unconstitutionally obtained (i.e. the evidence the police got from his apartment and the statements he made before he was given Miranda warnings) was entered into evidence, he should get a new trial in which the State is barred from entering that evidence against him.

In order to prepare this writing assignment, first read the hypothetical crime scenario information provided to you in this module. Also, review the information you were provided in previous modules. Then, review the attached examples of appellate opinions where courts have addressed appeals regarding motions to suppress based on the very same arguments Spoofy is making. Then, draft an appellate opinion that has the following components: (1) an introduction where you summarize the result below in the trial court, the crux of the appeal, and the result the appellate opinion reaches (e.g. affirm the conviction or reverse for new trial); (2) a brief recitiation of the operative facts necessary to understand the appellate opinion being rendered; (3) an analysis section where you discuss the relevant legal standards and apply those standards to the facts; and (4) a conclusion where you re-state the appellate court’s decision (e.g. either to affirm the conviction or reverse it). And in drafting this opinion, you can choose to either affirm or reverse; it is up to you. Just be sure to write persuasively defending the basis for your decision.

Being a whistle-blower in an organization takes both courage and confidence. Unfortunately, many employees fear retaliation if they were to report a questionable practice. Despite the increasing legal protections, retaliation rates remain high, according to the National Business Ethics Survey. “Twenty-one percent of U.S. workers who reported misconduct said they experienced retaliation, up from 12 percent in 2007” (Meinert, 2014, p. 62). The Sarbanes-Oxley (SOX) Act was enacted in 2002 as Congress’ response to corporate scandals at Enron and WorldCom. Most of the Act focuses on financial reporting and internal control requirements for publicly traded companies, but Congress also included provisions to protect insiders who report questionable practices. “In March 2014, the Supreme Court dramatically increased the number of companies that could be sued for retaliation against those who blow the whistle on securities fraud” (Meinert, 2014, p. 60). According to Barnett (1992), “Some say that whistleblowers are noble characters, willing to sacrifice personally and professionally to expose organizational practices that are wasteful, fraudulent, or harmful to the public safety. Others suggest that whistleblowers are, by and large, disgruntled employees who maliciously and recklessly accuse individuals they feel have wronged them in order to attain their own selfish goals.” As such, HR managers and professionals need to focus on creating an ethical culture that promotes transparency and accountability and where whistle blowing is encouraged and rewarded when the information benefits the organization. Furthermore, a policy must be drafted that states the protocol for whistle blowing. Many organizations have invested in a third-party whistle-blowing hotline where employees can call anonymously and discuss their concerns. By having a whistle-blowing policy, all employees of an organization will know that their decisions may result in disciplinary actions and/or termination.

The first major event that affected the constitution is quite obvious: ‘ break from . The book describes this break as a “constitutional crisis” (802). The declaration of independence contained several ideas that are still important to  today, such as the duty of the government to “Protect the lives, liberty and property of the people.” The constitution of 1836 closely resembled the constitution of the U.S. It included a bicameral legislature and an elected chief with considerable powers. The National Reconstruction Act also ended up having a huge influence on the current Texas constitution. Under the NRA, congress was granted power to appoint state governors. They appointed Edmund Davis the governor of Texas.  Because of the fact that the constitution had centralized power in the executive branch, Davis had a great amount of power. He used his power to create a “corrupt, extravagant administration that eventually turned to the state police and the Once Davis left office, a new constitution was drafted- and it was heavily influenced by the distrust caused by Davis. The constitution of 1876 called for a “strong popular control of government” and the ability to “seriously limit the power of state government’ (809). Another thing that is unique about ‘ constitution, is that it differs from the U.S constitution in several ways. One obvious difference is the length and . While the U.S.  has only been amended 27 times, has 7 articles and is flexible, the Texas constitution has been amended 474 times, has 16 articles and is described as “lengthy, confusing and highly restrictive” (811) (Video lecture). There are also some differences in clauses. The U.S constitution contains the supremacy clause, which basically states that laws of the United States are superior to the state laws. In cases of differences the US law will be acknowledged over state laws. The US constitution also contains the necessary and proper clause, which allows congress “the power necessary to accomplish it’s constitutional tasks” so, basically it grants congress power that is not explicitly stated in Article 1.
