Proseminar Crminal justice

The United States criminal justice system has a court system that is modulated in different parts. The Supreme Court is the highest authoritative court in the United States, and for cases to arrive at this court, they must pass through a variety of courts and have a legitimate consequence toward the nation.

You also have state, appellate, and local courts that serve jurisdictions where criminal cases are initially held and decided by a jury or a judge. It is vital to understand that certain crimes like fraud can be tried in the criminal sections of the criminal justice system, but there is also a civil justice system where parties seek civil relief for injustices that may or may not result from criminal activities. The civil courts, another set of courts, provide judgments over the civil cases. Judges decide if the plaintiff’s claim of harm by the defendant is justified.

Criminal cases are heard in criminal courts where, at the conclusion of the trial, the defendant may receive sentences of incarceration or fines as a result of being convicted at the criminal trial.

In a civil court, a person (plaintiff) pursues a civil action against another person (defendant), which may result from damages resulting from a criminal action of the defendant, an accidental action by the defendant, or a disagreement between the plaintiff and the defendant.

Please answer the following questions. As you answer each question, you must provide support or evidence that will enhance and empirically prove your answers. Academic criminal justice articles or real-life criminal justice findings that are not found in journals or other academic sources must be used in supporting your answers. Please use APA style for all cited sources, including your References page.

What is the dual-court system?
Why does America have a dual-court system?
Could the drive toward court unification eventually lead to a monolithic court system?
Would such a system be effective?

Judges have specific philosophical rationales and sentencing guidelines when providing a judgment over presented facts.

If you were a judge, what would be your sentencing goals and philosophical rationales? Why?
Can you envision any circumstances that might make your guidelines or sentencing goals change? Why?
Provide an example of a situation that might be extremely difficult to judge that could put you as a judge in a situation to change your sentencing goals or philosophical rationales.

Choose 12 of the 22 ethical standards that you feel are the most important. Make sure that there is at least 1 ethical standard for each of the 5 guiding principles.

Then create a PowerPoint presentation that covers the following:

Explain why ethical standards are needed.
Identify what each of the 5 guiding principles represents, and why each is important for educational researchers.
List the 12 ethical standards chosen.
Give an example of how each of the chosen 12 ethical standards would be used in qualitative research for data collection.
Give an example of how each of the chosen 12 ethical standards would be used in quantitative research for data collection.
Provide examples of how the ethical standards selected might impact methods of collecting data.
Summarize why it is important for each individual researcher to follow these ethical standards.

PowerPoint slides should have a professional-looking background and short bullet points on the slide, with the explanation and comments (presentation script) in the notes section. The slideshow should have some graphs or charts and appropriate clip art or photos to make the presentation interesting. Review the 5 guiding principles, and choose 1 of them that is of particular interest to you. Be sure to coordinate with your group to avoid duplication.
Select 3–4 ethical standards that you believe align with your selected guiding principles, and do further research.
Post a discussion of the chosen principle and the chosen ethical standards. Provide rationale for your belief in their importance. Support your statements with credible academic sources.
Review the individual posts of your group members, and provide feedback.

For the Session Long Project this session you will be applying the concepts from the background materials to your own personal experiences in the workplace. You likely have experienced many if not all of the concepts at one point or another in your career, but you may not have been familiar with the precise terminology.

In preparation for the SLP, make sure you have a thorough grasp of the terminology from the background materials including the main sources of power and types of power tactics. Once you are comfortable with the terminology and concepts from the background materials, think of a manager that you worked with closely who held a fair amount of power at the organization you worked for. Then write a 2- to 3-page paper addressing each of the following questions. For each answer, make sure to cite at least one reference from the required background readings.

What were this manager’s main sources of power? Include a discussion of reward power, legitimate power, and expert power as well as other sources of power discussed in the background readings.
Discuss some power tactics used by this manager. Include a discussion about whether or not this manager used the power tactics discussed in Anderson (1998) and Nair (2010) from the background materials.
Did this manager make good use of his or her sources of power and power tactics, or did they misuse or abuse their power?
